§1The Durable Power
A court-appointed "conservatorship" will be required for any asset owner who becomes legally incapacitated having neither a (financial) Durable Power of Attorney Over Assets (DPAOA) nor a fully funded trust in place. The DPAOA is the inexpensive, private alternative — and most families have never executed one with sufficient breadth to actually function in a crisis.
